TIER II REPORTING

The Tier II Report Forms and fees are due annually by March 1 from facilities meeting the reporting requirements.  The Tier II reporting requirements and fees can be found in the How To Comply Packet (MS Word 169kb)”.  Kentucky requires hardcopy submission of Tier II but requests electronic submission as well.  The EPA’s Tier 2 Submit program  can be used to produce both hardcopy and electronic submissions.  The KYERC will also accept the Kentucky Tier II Form (MS Word 380 kb).  EPCRA allows the exact location of hazardous substances at a facility to be kept confidential.  Facilities wishing to keep this information confidential must submit the Tier II Confidentiality Form (MS Word 294 kb) as well as the Tier II Form.  Companies operating multiple facilities are requested to use the Multiple Facility Form (MS Word 174kb) when submitting Tier II fees.  A list of Extremely Hazardous Substances (PDF 333 kb) is provided to aid you in filling out the Tier II Form and determining the appropriate fee.

The KYERC is dedicated to simplifying Tier II submission while constructing a comprehensive database of hazardous material filers.  To aid us in this mission we are requesting that you fill out the Facility Registration Form (PDF 484 kb)per the Facility Identification Form Instructions (MS Word 49kb) provided, if you are submitting on behalf of an individual facility.

The Kentucky Emergency Response Commission was formed in 1988 to meet the requirements of the Emergency Planning and Community Right to Know Act and provide to our citizen’s information regarding hazardous substances in their communities.

 

The KYERC is composed of 25 members appointed by the Governor to two year terms who serve on five committees (MS Excel 38 kb) .  Members represent first responders, elected officials, environmental and health concerns, industry, county and local emergency management who are broken into subcommittees.  The KYERC quarterly meetings are open to the public. KRS39E - Kentucky Emergency Response Commission (PDF 144kb) requires the Director of Emergency Management to serve as Chair.

 

The duties of the KYERC include providing administrative support to the Local Emergency Planning Committees (LEPCs).  Although Kentucky’s Local Emergency Planning Districts correspond to counties, Kentucky has 118 LEPCs (LEPC Chairs by County( (MS Excel 114kb)because Boone, Campbell and Kenton Counties have joined together to form the Northern Kentucky Emergency Planning Committee.

FACILITY PLAN REQUIREMENTS                     

Section 302(c), KRS 39E.130

 

Facilities subject to the planning requirements must notify the Kentucky Emergency Response Commission, the Local Emergency Planning Committee (LEPC) and the Fire Department with jurisdic­tion that they are subject to the planning provisions.  Facilities must notify the LEPC of the facility emergency coordinator who will work with the local committee and who shall provide information necessary to the development of those plans.­ 

 

Annual review is required by March 1.  If you have an approved plan, please review that plan.  Do not develop another plan.
