Temporary Suspension of KYEM Provisional Instructor/Facilitator or Instructor/Facilitator Credentialing
The Director of the Kentucky Division of Emergency Management, may determine that an immediate temporary suspension of a KYEM Provisional Instructor/Facilitator or KYEM Instructor/Facilitator credential is warranted against a natural person with whom an investigation is pending when it is determined that such action is necessary in order to protect the public. When a temporary suspension is deemed necessary, the Director, in writing, shall issue an emergency order suspending the credential. An individual that has been served with a temporary suspension may appeal such action within seven (7) calendar days of the action. Upon receipt of a duly authorized request for appeal, a hearing shall be conducted in accordance with KRS 13B.125 within ninety (90) days of the receipt of an appeal, unless the individual filing the appeal requests an extension of time. Under no circumstances shall the hearing date be extended beyond one hundred and fifty (150) days of the date of the request forthe appeal. An order of Temporary Suspension, once issued, shall remain in effect until either retracted or superseded by final action of the Director of the Division.
